Returning to Work
At Smith & Baltaxe, LLP, we help people obtain workers' compensation benefits, and help them return to work when they are able to do so. There are many questions to consider when returning to work after a job injury:
- Can you perform most, but not all of your job duties? Your employer is required to determine whether or not they can make changes to your job duties to accommodate your diminished capacity to work.
- Is there another job within the company that you could do? If so, the job must last at least one year and pay at least 85% of your previous income.
Our attorneys will help you explore your legal options in regard to returning to work. If there is a dispute over whether you are able to work again or in what capacity you are able to return, we will stand up for your rights against the insurance companies.
Vouchers
If you are permanently disabled and unable to perform the duties of your job, you may be able to receive a voucher for education and skill enhancement. To qualify for a voucher:
- Your injury must have occurred after January, 1, 2004
- You must be permanently disabled
- You must not return to work within 60 days after your temporary disability ends
- Your employer must not have offered you modified or alternative work
The maximum voucher amount is $10,000.
